Two youths acquitted of raping cousin

A court has acquitted two brothers of the charges of raping their minor cousin sister, saying the possibility of them being falsely implicated to settle a business rivalry between them and the girl's father cannot be ruled out.

Additional Sessions Judge Vikash Dhull let off the two south Delhi residents of charges committed under sections of Protection of Children from Sexual Offences Act and IPC as neither the 17-year-old girl nor her parents testified that she had been raped by the two youths.
The court also said that since the alleged offence took place in the year 2010-2012 and the FIR was registered in September 2013, it makes the case "highly untrustworthy, unbelievable and open to manipulation and concoction." "In the light of non-explanation of such an inordinate delay, the prosecution case has become unreliable and untrustworthy and possibility of accused being falsely implicated to settle business rivalry going on between the father of child victim and the accused persons cannot be ruled out," the court said, noting that no explanation has been given by the prosecution for such an inordinate delay in getting the case registered.
She had also deposed that there was a business dispute between the youths and her father, the court noted. The prosecution had alleged that one of the accused had raped her in 2010 after giving her an intoxicating substance in a soft drink, while the other accused had raped her in 2012.

Man gets jail for raping air force staffer's wife

A 55-year-old man has been awarded 10 years' rigorous imprisonment by a Delhi court for raping and pouring hazardous "chemical" on the private parts of the wife of an Air Force staffer.

The convict, who was friendly with the 40-year-old victim's husband, committed the heinous offence at her residence.

Additional sessions judge MC Gupta handed the jail term to Narayan, an agriculturist by profession and a resident of Bhalswa Dairy here, for the offence of rape and causing hurt to the woman by means of poison or corrosive substance.

The court also imposed a fine of Rs 25,000 on Narayan. It also noted that the victim had made a "futile attempt" to conceal the fact of her rape by changing her statement before court.

"A conjoint reading of the said dependable part of the testimony of the prosecutrix (woman) so established on record, coupled with the DNA report ... clearly indicates that sexual intercourse activity has taken place in the case and it was none else but accused Narayan who has performed the act of sexual intercourse with the woman against her will.

An auto driver get 10 year jail for raping a women

An auto driver accused of cheating a widow and having physical relation with her on the false promise of marriage. He has been sent to ten years in jail by Delhi Court “very serious sentence”.

Additional sessions Judge Virender Bhat turned down the mercifulness of Bihar native Sikander Chaudhary, who was already married and had claimed to be sole worker of his family, saying “the extent of the family of convict does not persuade me to impose a lenient sentence upon him, as it was for him to think about his family before committing the offences".

First, he took her consent for sexual intercourse by falsely representing that he is unmarried and would marry her whereas he knew that he cannot solemnise marriage with her as he is already married. "Then he took away Rs. one lakh from her on the assurance that he would purchase an auto rickshaw in her name, which he never intended to do," said the court, which also imposed a fine of Rs. 1.25 lakh on Sikander.

Sikander, an auto driver, was arrested by the police on October 9, 2013 after the victim lodged a case here alleging that he had in March 2013 applied vermilion on her forehead saying they are married and later raped her while promising that he would take care of her children.

The woman, a native of Bihar and working as a domestic help, in her complaint to Dabri police station here said that the accused had told her that he was unmarried.

"He (Sikander) assured her that he would perform a social marriage also with her as per all the rites and ceremonies. On August 28, 2013, the accused demanded Rs. one lakh from her and told her that he would purchase an auto rickshaw in her name.

"The woman withdrew the amount and handed over the same to Sikander. The accused, thereafter did not return to her," the complaint states, adding that later she came to know for the first time that Sikander was already married.
